Transvaginal Mesh Lawsuit

Transvaginal mesh is a surgically implanted device used to treat POP and stress urinary incontinence (SUI). POP and SUI occur when the tissues that hold the pelvic organs become stretched or weakened. 30% to 50% percent of women develop POP in their lifetimes, while 20% to 40% of women are affected by SUI. During transvaginal mesh surgery, a mesh device is implanted inside the vagina to support the prolapsed organs. Furthermore, this type of treatment can be used to reinforce the vaginal wall. A vaginal mesh device can also be used to treat SUI and to provide support for the urethra.  If you or anyone you know may have suffered an injury related to mesh, please contact the lawyers with the Drug Injury Legal Group immediately to discuss the potential for a transvaginal mesh lawsuit.

Vaginal Mesh Lawyer

The choice of lawyer to represent you for you injuries suffered as a result of the vaginal mesh product that you received is a very important one.  The vaginal mesh lawyers at The Drug Injury Legal Group have decades of experience litigating against the largest and most powerful multinational corporations in the world.  Your vaginal mesh lawyer should be well versed in the discovery process and litigation involving federal courts and multi-district litigations (“MDL”).  The MDL process is one in which our lawyers have handled thousands of cases and settled those thousands of cases for a cumulative total in the hundreds of millions of dollars.  An experienced transvaginal mesh lawyer should be able to identify the correct defendant and file suit in the forum that maximizes the potential for recovery in your case.  Many times, it is in the best interest of victims of vaginal mesh implants to file cases in state court to avoid the MDL process.  An MDL can be a fantastic venue for a mesh implant lawyer to allow a case to go to.  However, there are instances where the MDL has terrible precedent, such as a ruling that will not allow a new and favorable study to be shown to a jury.  In a situation like this, allowing your vaginal mesh case to be swept into an MDL would potentially be fatal to your case.

Transvaginal Mesh Injuries

The issue with the use of transvaginal mesh implantation in women is that it tends to disseminate into areas other than where it was implanted inside of a the woman’s body who received the implant.  The erosion of the mesh implant through vaginal walls can happen following the surgery in a fairly short amount of time.  It can take anywhere from weeks to months for the erosion of the transvaginal mesh to occur.  The complications that are suffered by women who experience the erosion of the vaginal mesh product include but are not limited to the following:

  • Mesh erosion
  • Painful sexual intercourse, also known as dyspareunia
  • Urinary incontinence
  • Additional surgery
  • Pain of the abdomen and pelvis

The injuries that a woman suffers as a result of a vaginal mesh implant that does not work as it was intended include injuries that are not just physical.  Women who suffer from transvaginal mesh side effects may notice that they are not as effective at work and they may experience a deterioration of the relationships that they have long held.  It has been argued that vaginal mesh should not be used at all in women because it does not work for the purpose it was originally intended and the side effects are frequent and severe and could include the need for additional surgeries.  If you would like to speak with a vaginal mesh lawyer about filing a lawsuit for the injuries that you suffered because of the erosion of a transvaginal mesh product that you had surgically implanted, please contact one of the lawyers with the Drug Injury Legal group immediately.

FDA Warning about the Risks of Transvaginal Mesh Injuries

In October of 2008, the FDA issued a Public Health abdominal painNotification to inform patients and doctors about the adverse side effects associated with transvaginal mesh.  In this notification, the FDA stated that the side effects of POP and SUI were rare.  In July of 2011, the FDA amended this Notification to state that the serious side effects of POP and SUI are not rare, as the FDA previously believed.  The FDA further stated that transvaginal mesh “does not appear to provide any medical benefit over traditional surgeries without mesh, and may add an additional risk to patients.”

From its 2011 review of the medical literature, the FDA concluded that mesh erosion can require multiple surgeries to repair and can be debilitating for some women and that in some cases, even multiple surgeries will not resolve the complication.

Critically, in its 2011 Amended Notification, the FDA recommended to health care providers that in most cases, POP can be treated successfully without mesh thus avoiding the risk of mesh-related complications.
